New York VA One-Time Close Construction Loans

New York splits into a downstate market where VA construction math rarely works and an upstate one where it often can. Add a mortgage recording tax and attorney closings, and the plan needs care.

New York is really two construction markets

Talk to a veteran in Brooklyn and a veteran near Watertown about building a house, and you will think they live in different countries. In the New York City metro, build costs are so extreme that the math behind a VA One-Time Close loan is nearly impossible for most borrowers. Upstate is far more affordable, though Fort Drum's rural setting brings its own problem: thin comps.

The reason both ends matter is the appraisal. A VA OTC loan wraps the land, construction and permanent mortgage into one loan with one closing, with zero down for eligible veterans who have full entitlement. The completed home still has to appraise for the Total Acquisition Cost, which adds up the lot, build contract, contingency, construction interest and funding fee. Too expensive and the comps cannot reach it. Too remote and there may be no comps at all.

Region by region, downstate to upstate

New York City metro

Extremely expensive. Comps exist only at very high price points, and Fort Hamilton in Brooklyn notwithstanding, very few VA builds pencil here.

Long Island / Hudson Valley

Expensive, with moderate to strong comps. The Hudson Valley is also home to the US Military Academy at West Point.

Watertown / Fort Drum area

The home of the 10th Mountain Division. Small and military-driven, with thin comps at higher prices. A modest plan has the best shot.

Syracuse / Rochester / Buffalo

The upstate metros offer the best overall balance for VA OTC: moderate costs, affordable land and workable comp support.

Albany / Capital District

A moderate market shaped by state government.

If you are flexible on location, the upstate metros are where we would point a friend first. Test your numbers with the cost estimator before falling for a lot.

The mortgage recording tax nobody warns you about

Most states on this site charge recording fees and little else. New York is different. It charges a mortgage recording tax, roughly 0.75% to 1.925% depending on county and loan size, and higher in New York City. On a construction loan that covers land, build and contingency, that is a meaningful number, and it belongs in your budget from day one rather than as a surprise on the closing statement.

Ask the closing attorney for the exact figure for your county and loan amount. It is one more reason the upstate math is friendlier than downstate.

Attorneys run the table in New York

Attorney-conducted closings are the strong, near-universal custom in New York, especially downstate, and closed-end loans are wet-funded. Expect your own attorney and the lender's to be involved.

On signatures, New York is simpler than many states. Dower and curtesy were abolished, so a non-titled spouse generally does not have to sign, and the homestead is a creditor protection rather than a signing rule. Confirm vesting with the title company anyway. New York uses judicial foreclosure, and lender advertising must carry the Department of Financial Services legend, which helps you spot who is actually licensed.

VA requirements that travel with you

Wherever in New York you build, the builder must be registered with VA and hold a VA builder ID; see builder approval. The VA appraiser values the home from plans, specs and VA Form 26-1852 and issues a Notice of Value. Many lenders look for credit around 660. The funding fee is 2.15% first use or 3.3% subsequent use at zero down, and it is waived with VA disability compensation. Money is released in draws after inspections.

New York VA OTC questions

Can I realistically build with a VA OTC loan in New York City?

For most borrowers, no. NYC metro build costs are extreme, and comps exist only at very high price points, so the total acquisition cost rarely appraises. Long Island and the Hudson Valley are expensive but have moderate to strong comps, and upstate metros offer far better balance.

How much is New York's mortgage recording tax on a construction loan?

New York charges a mortgage recording tax of roughly 0.75% to 1.925% depending on county and loan size, and it runs higher in New York City. Ask the closing attorney for the exact figure for your county and loan amount, and build it into your budget early.

Is Fort Drum a hard place to get a VA construction appraisal?

It can be. The Watertown area is small and military-driven, with thin comps at higher prices. A modest, practical design gives the appraiser the best chance to support the full cost. Bigger custom builds are where Notices of Value tend to fall short.

Does my spouse need to sign if they are not on title in New York?

Generally not. New York abolished dower and curtesy, so a non-titled spouse usually does not have to sign, and the homestead acts as a creditor protection rather than a signing requirement. Confirm vesting with the title company to be sure for your property.
