Massachusetts VA One-Time Close: Attorney Closings and High Build Costs

In Massachusetts an attorney runs the closing and construction costs run high everywhere. Both facts shape whether a VA one-time close build makes sense.

Start with the closing table

Most states let a title company handle the whole thing. Massachusetts does not. The state requires an attorney to conduct a real estate closing, so you should expect an attorney at the table for your construction loan. That is not a problem. It is just one more professional to line up early, along with a builder who is VA-registered with a VA builder ID and a lender licensed in Massachusetts.

The price-point squeeze

Massachusetts has high construction costs across the board. A VA one-time close requires the finished home to appraise for the Total Acquisition Cost: the lot, the build, the contingency, the accrued interest and the funding fee together. When build costs are high, the appraisal needs strong comps at high price points to keep up, and that limits viable areas to established suburban markets.

The appraisal happens up front, from plans and specs using VA Form 26-1852, and produces a Notice of Value. If the value falls short of your total, you need to close the gap before you close the loan. Read the appraisal guide and test your numbers with the cost estimator before you sign for land.

Base areas and what surrounds them

Hanscom AFB

Bedford

Electronic Systems Center in the Boston metro, where comps exist at very expensive price points.

Natick Soldier Systems Center

Natick

Army research west of Boston, also in high-cost suburban territory.

Joint Base Cape Cod

Bourne

Otis ANGB, Air National Guard and Coast Guard, in a seasonal Cape Cod and Plymouth market.

Westover ARB

Chicopee

The Air Force Reserve C-5M wing, in the more affordable Springfield and Western MA area.

Region by region

The Boston metro is very expensive, and while comps exist at high price points, the margin for error is slim. Cape Cod and Plymouth is a seasonal market around the base, which can make comparable sales uneven. Worcester and Central Massachusetts is growing and moderate, often a reasonable middle ground. Springfield and Western Massachusetts are more affordable, but comp support is thinner, so a modest plan has a better chance of appraising than an elaborate one.

Take a reservist flying with the C-5M wing at Westover who wants to build near Chicopee instead of commuting from somewhere pricier. Western Massachusetts makes the cost side easier, but the thinner comp support means the plan should look a lot like homes that have already sold nearby. Skip the oversized bonus room, pick finishes the local market actually pays for, and carry a real contingency. That reservist will also want a builder who already holds a VA builder ID, because recruiting a builder into VA registration mid-deal adds time, and time on a construction loan is interest. Compare that picture to a Hanscom family in Bedford, where comps exist but the starting price is so high that a small overrun can sink the appraisal.

Rules worth knowing before and after the build

A non-titled spouse generally does not need to sign on a Massachusetts refinance, and a declared homestead attaches automatically. Massachusetts does not impose a mortgage recording tax, so recording runs on flat fees. The state requires pre-closing housing counseling on high-cost loans, and a loan made without required counseling can be void. If you later refinance, note that Massachusetts allows a four-year right to rescind for defective disclosures, beyond the federal three-day window. Foreclosure is non-judicial by power of sale, and remote online notarization is available with attorney involvement.

On the VA side, the zero-down funding fee is 2.15 percent on first use and 3.3 percent on subsequent use, and veterans receiving VA disability compensation are exempt. Builders are paid in draws after inspections, and interest accrues during construction. Many lenders want a credit score around 660 for this loan; you can check where you stand at do you qualify.

Massachusetts VA OTC questions

Who runs the closing on a Massachusetts VA construction loan?

An attorney. Massachusetts requires an attorney to conduct a real estate closing. Your Massachusetts-licensed lender will coordinate with that attorney, so ask early who will represent the lender and whether you want your own attorney as well.

Is Western Massachusetts a better bet for a VA one-time close than the Boston suburbs?

It is more affordable, which helps your total cost, but comp support is thinner around Springfield and Western MA. The Boston metro has comps at high price points but very high costs. Worcester and Central MA is a growing, moderate middle ground worth comparing.

I am at Hanscom. Can I afford to build nearby with zero down?

Possibly, but the Boston metro is very expensive, so the finished home must appraise for a large Total Acquisition Cost. Strong comps exist at high price points, yet there is little room for overruns. Get a realistic budget and appraisal read from a Massachusetts-licensed lender first.
